Terms of Service

1. Agreement to Terms

By accessing or using Stogify ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Eligibility

You must be at least 21 years of age to use Stogify. By using the Service, you represent and warrant that you are at least 21 years old and have the legal capacity to enter into these Terms. Stogify is a cigar collection management tool and is intended for adult tobacco enthusiasts only.

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Billing

4.1 Free Tier

The Free tier includes limited access to the Service with up to 10 cigars in your vault and 5 tasting journal entries. Free tier users do not have access to premium features.

4.2 Vault Premium Subscription

Vault Premium is available at $9.99/month or $75/year and includes unlimited cigar storage, unlimited tasting entries, AI Tasting Assistant, CSV export, Wish Vault, and Humidor management features.

4.3 Billing

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• All payments are processed securely through Stripe
• Prices are subject to change with 30 days notice
• You are responsible for all applicable taxes

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or the Stripe customer portal. Upon cancellation, you will retain access to premium features until the end of your current billing period. We do not provide refunds for partial billing periods, except where required by law.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Upload or transmit viruses, malware, or other malicious code
• Use automated scripts to collect information or interact with the Service
• Impersonate another person or entity
• Share your account credentials with others
• Use the Service to promote the sale of tobacco products to minors
• Violate any applicable tobacco advertising regulations

6. User Content

You retain ownership of any content you submit to the Service, including cigar data, tasting notes, and images ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your User Content solely for the purpose of providing the Service.

You are responsible for your User Content and represent that you have all necessary rights to submit it. We reserve the right to remove User Content that violates these Terms.

7. AI Tasting Assistant

The AI Tasting Assistant feature provides suggestions and recommendations based on your collection and preferences. AI-generated content is for informational purposes only and should not be considered professional advice. We do not guarantee the accuracy or completeness of AI-generated recommendations. Use of the AI feature is subject to third-party AI provider terms of service.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Stogify and are protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

9. Third-Party Services

The Service may contain links to or integrate with third-party websites and services (such as Stripe for payments). We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOGIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Stogify and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, violation of these Terms, or violation of any rights of another party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
